These Terms of Service ("Terms") govern your access to and use of the homebuyer search tool available at buyers.empirehomepath.com (the "Service"), operated by Empire HomePath LLC ("Empire HomePath," "we," "us," or "our"). These Terms are separate from those governing our agent- and broker-facing platform at empirehomepath.com. By using the Service, you agree to be bound by these Terms, our Disclaimer, and our Privacy Policy, each incorporated by reference.
You must be at least 18 years old and capable of forming a binding contract under New York law to use the Service. By using the Service, you represent that you meet these requirements.
The Service allows you to search for homebuyer assistance programs in New York State based on information you provide, including location, home price, household income, and eligibility-related criteria. A free preview shows limited results (program count and category only). A one-time payment unlocks full program details, including eligibility specifics, program contacts, and a downloadable PDF report, as described in the pricing shown at checkout.
The Service does not require you to create a traditional account or provide your name or government identification. Your session is tied to the email address (and, where applicable, phone number) you provide at checkout. You are responsible for the accuracy of the search information you enter, including household income and location, as your results depend on it. See our Privacy Policy for details on how this information is handled.
The unlock fee is a one-time, non-recurring payment processed securely through Stripe. Pricing is displayed at checkout prior to purchase. All sales are final, except as described below.
Refunds are limited to verifiable technical delivery failure — meaning our payment and system records show that your payment was processed but the unlock, full results, or PDF report were not successfully delivered to your account or session. If you experience this, contact us at empirehomepath@gmail.com within 30 days of purchase, and we will review our transaction and system logs to confirm whether delivery occurred.
Refunds are not available on the basis of dissatisfaction with search results, disagreement with your eligibility for a listed program, or a program later proving unavailable, changed, or inapplicable to your situation. These outcomes are addressed in our Disclaimer (Sections 2 and 4) and do not constitute a failure of the Service.

All content, design, software, and compiled program data made available through the Service are the property of Empire HomePath LLC or its licensors and are protected by applicable intellectual property laws. Your purchase grants you a limited, personal, non-transferable license to use your search results and PDF report for your own personal homebuying purposes — it does not grant you rights to the underlying database or compilation.
Homebuyer assistance programs referenced through the Service are administered by independent third parties (government agencies, municipalities, CDFIs, nonprofits, employers, etc.). Empire HomePath is not the administrator of any listed program, is not affiliated with any government agency, and does not process applications on your behalf.
The Service is provided subject to the disclaimers, "as-is" terms, and limitation of liability set forth in our Disclaimer, which is incorporated into these Terms by reference. Nothing in these Terms limits any right you have under New York General Business Law §349 or §350, or any other non-waivable New York consumer protection statute.
We may suspend or discontinue your access to the Service at any time for violation of these Terms or for operational or legal reasons. You may stop using the Service at any time. Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be reflected by updating the "Last Updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Agreement to Arbitrate. Except for claims that qualify for small claims court, you and Empire HomePath LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in New York State, or may be conducted remotely/by written submission where permitted by AAA rules, at your election.
Class Action Waiver. You and Empire HomePath LLC agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Empire HomePath LLC.
Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to empirehomepath@gmail.com within 30 days of first accepting these Terms. Your notice must include the email address used for your purchase and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state and federal courts located in New York State, and you consent to personal jurisdiction there.
Severability. If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than in arbitration, while the remainder of this Section remains in effect.
These Terms, together with our Disclaimer and Privacy Policy, constitute the entire agreement between you and Empire HomePath LLC regarding the Service and supersede any prior agreements.
